Why does Roe v Wade matter with abortion laws?
In 1973, the Supreme Court decided that the federal government could no longer completely outlaw abortion. Instead, each state would determine at what point in a woman’s pregnancy abortion would be illegal. This case was referred to as Roe v Wade. [1] Other laws and cases over the years have been brought back to the Supreme Court. For example, in 1992, the Supreme Court again revisited Roe v Wade, but determined to uphold the ruling and instead add a few stipulations for women seeking an abortion. This case was known as Planned Parenthood of Southeastern Pennsylvania v Casey. [2] Until recently, Roe v Wade has remained in effect.
What happened in Dobbs v Jackson Women’s Health Organization?
A court case concerning abortion began in Mississippi and eventually made its way to the Supreme Court. After much deliberation, they determined that the original Roe v Wade ruling was not constitutional, so they overturned the ruling from 1973. [3] Now, individual state legislatures will determine their own abortion laws. So, laws will vary state by state.
What even is the Supreme Court?
As outlined in the Constitution, the Supreme Court is the highest court within the Judicial Branch. Nine Justices regularly deliberate on various laws and court cases to determine whether they align with the Constitution. They have the power to change or overturn a law. As they did with Roe v Wade. How will an ectopic pregnancy be treated in the future?
The Supreme Court decision does not alter how an ectopic pregnancy will be treated. In an ectopic, the pregnancy implants outside of the uterus and can be life-threatening. Treatment usually entails a doctor administering a medication that stops the pregnancy from growing or requires surgical intervention to remove the pregnancy. So, doctors are legally able to continue treating women for an ectopic pregnancy.
